Server Compliance?

How come the PokéFind server is, in many ways, non-compliant with the restrictions in the Minecraft EULA? The quality of the server's builds, models and plugins indicate great forethought by the developers, so surely they (should) know there are rules to be followed that protect vulnerable, often young players from financially predatory behaviour?
